Applying to the Insurance Arbitration Commission: time limits, costs and documents

The Insurance Arbitration Commission is a body that resolves disputes between insurers and insured or injured persons through specialist arbitrators. It was established by Article 30 of Insurance Law No. 5684. Diminished value disputes arising from compulsory traffic insurance make up a significant share of applications to the Commission.

Precondition for applying

Before applying to the Commission, a written application must have been made to the insurer. If the insurer does not respond positively within 15 days, rejects the claim or makes an incomplete payment, an application can be made to the Commission. All insurers issuing compulsory traffic insurance policies are in the Commission's system.

Required documents

• Accident report or police report

• Vehicle registration certificate

• Appraisal report and repair invoices

• Copies of the application made to the insurer and its response

• If any, the payment letter, bank receipt and signed release

• Accident photos

• A power of attorney if the application is made through a representative

Costs

An application fee determined according to the amount in dispute is paid at the time of application. Current fees are published on the Insurance Arbitration Commission's website. If an expert examination is required, an expert fee may also apply. If the application is accepted, costs may be imposed on the other party in line with the decision.

How does the process work?

1. The application is made online or in writing.

2. The Commission carries out a preliminary review and appoints an arbitrator.

3. The arbitrator orders an expert examination if necessary.

4. The parties are given the opportunity to make submissions.

5. The arbitrator issues the decision.

Depending on the amount in dispute, an objection to the arbitrator's decision may be made to the objection panel; for decisions above certain amounts, appeal is also available. These amount thresholds are updated every year.

Difference from court proceedings

There is no obligation to go to mediation before applying to the Commission; the process usually concludes faster than in court. On the other hand, the court route may be preferred in some disputes. Which route is appropriate should be assessed according to the specific case.
