Lease termination dates

Ten-year extension, notice deadline and eviction filing periods from the lease start date.

When can a landlord end the lease?

For residential and roofed commercial leases, the lease renews for a year if the tenant stays. After a ten-year extension period, the landlord may terminate without cause by giving at least three months' notice before the end of each extension year (Art. 347).

Actions based on need, reconstruction or a new owner must be filed within one month from the end of the term; an action based on two justified notices in a lease year, within one month from the end of that lease year.

FAQ

Is mediation required before an eviction action?

Yes, for lease disputes mediation is mandatory before filing, except for eviction through enforcement without judgment.

What if the tenant wants to leave early?

In a fixed-term lease the tenant must give notice at least 15 days before expiry, otherwise it renews; leaving early may entail rent liability for a reasonable period.
